These terms are an agreement between you and Tesselex Software Inc. ("we", "us") for your use of the Repbeat app and its services. By using Repbeat you agree to them. If you got Repbeat from Apple's App Store, Apple's standard licensed-application terms also apply, and where they conflict on App Store matters, Apple's terms win.
Repbeat is a workout timing and guidance tool, not a medical device, and its coaching is not medical or professional fitness advice. Consult a physician before starting any exercise program, especially if you have a medical condition. Stop exercising if you feel pain, dizziness, or discomfort. You are responsible for training within your abilities, using correct form and appropriate weights, and staying aware of your surroundings — voice guidance and haptics are conveniences, not a substitute for your own judgment. Heart-rate and calorie figures come from your Apple Watch and are estimates. You use Repbeat at your own risk.
We grant you a personal, non-transferable, non-exclusive license to use Repbeat on Apple devices you own or control, for your own training. Don't copy, modify, resell, reverse engineer, or misuse the app or its services (including the voice-rendering service), and don't use them in any unlawful way.
Repbeat Pro is an optional auto-renewing subscription (monthly or annual) billed by Apple through your App Store account, with a free introductory trial for eligible new members. Payment is charged when the trial ends unless you cancel at least 24 hours before; the subscription renews automatically until cancelled in your App Store account settings (Settings → your name → Subscriptions). Deleting the app or your Repbeat account does not cancel the subscription. Prices may change; Apple will notify you and seek consent where required. Refunds are handled by Apple under App Store policy.
An account (Sign in with Apple) is optional and enables sync and the studio coach voices. You can delete your account and all synced data anytime in Profile → Delete account. How we handle data is described in the Privacy Policy.
We aim to keep Repbeat and its online services (sync, voice rendering) available and improving, but they're provided "as is" and "as available", without warranties of any kind to the extent the law allows. We may modify, suspend, or discontinue features, apply fair-use limits to the voice-rendering service, and update these terms — if we make material changes, we'll surface that in the app or on this page, and continuing to use Repbeat means you accept them. Music you play through other apps or Apple Music remains subject to those services' terms; you're responsible for your rights to the audio you play.
To the maximum extent permitted by law, Tesselex Software Inc. is not liable for indirect, incidental, special, or consequential damages, or for personal injury arising from your exercise activity, and our total liability for any claim relating to Repbeat is limited to the amount you paid us for the service in the twelve months before the claim. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.
You can stop using Repbeat anytime. We may suspend or terminate access for breach of these terms or misuse of the services. Sections that by their nature should survive (disclaimers, liability limits) survive termination.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Nothing in these terms limits consumer rights you're entitled to under your local law.
